On August 1, 2007, Laos joined the Hague Convention on the Protection of Children & Cooperation with regards to Inter-country Adoption. This is actually referred to as the Hague Adoption Convention. The Hague’s sole responsibility is to ensure the safety of international adoptions with the respect to human trafficking. They set strict guidelines on who can adopt a baby from a Hague nation. For instance, you have to be a certain age and have a certain standard of health. Most of the time gay intended parents cannot adopt a baby from a Hague nation. Because of these strict guidelines, some worry that Laos government officials could use these laws as a base in interpreting surrogacy laws in Laos and thus make it difficult for an intended parent to take their baby out of the country. One thing to note is this is just a theory. Laos Fertility has not heard of any cases where this actually occurred.

Nevertheless, this beautiful, small country has become an international destination for intended couples, both heterosexual and gay, to do surrogacy in Laos. Laos is the only remaining country where intended parents can turn to make their families, and the cost is also a huge factor. It costs about 1/3 the price of the U.S.

Contrary to some media reports of the future of surrogacy in Laos, there have been some positive signs that the Laosn government has openly accepted the practice. In fact, the Laosn Health Minister has said that they will draft a new law that helps to regulate surrogacy in the kingdom. Representatives from the Health Ministry have been in contact with IVF clinics in Laos to build a framework of the new law. However, as of today, no new laws have been drafted or sent to the Parliament.

After the baby is born through a surrogate, the intended father has to declare the baby with the surrogate and ask legal permission from her that his name be placed on the birth certificate. For the baby to be able to leave Laos, the father must also get the permission from the surrogate mother when applying for a passport and birth certificate from his embassy.

While surrogacy in Laos may not seem like an obvious choice for many intended parents, the fertility clinics in Laos are reputable and many were opened by doctors from Bangkok and are well funded. These Thai doctors bring decades of experience in the fertility field and some are world renowned fertility doctors. Therefore, intended parents can feel safe doing surrogacy in Laos.
